This <a href="http://www.opensource.org/press_releases/certified-open-source.html">press release</a> at the Open Source website clarifies the OSI's position on the trademark issue. Essentially, the term "Open Source" cannot be trademarked since it is "too descriptive." The OSI has come up with a new certifications mark, "OSI Certified."
